General Rental Conditions

Introduction
The general rental conditions apply to all rental agreements with respect to a holiday villa at Borgo La Casa between a tenant and the owners of the property.

The term ‘tenant’ refers to the person or legal entity entering into a rental agreement with the owners and will also include the person (or legal entity) on whose behalf the tenant enters into a rental agreement (hereafter also referred to a co-tenant) with the owners.

The term ‘owners’ refers to Mr. and Mrs. Buné as owners of Borgo La Casa.

The term ‘rental agreement’ refers to a rental agreement directly with the owners. On rental agreements through an agency the general terms and conditions of the agency will generally apply unless otherwise stated.

The term ‘website’ refers to www.tuscany-holidayvilla.com / www.toscane-vakantievilla.nl.

The rental agreement and the general rental conditions will be subject to Dutch law.

Reservations and payments

Reservations can be made using the contact form on the website or by sending an e-mail to info@toscane-vakantievilla.nl. The owners will then provide a summary of the rental costs, the applicable security deposit and the end cleaning costs (to be paid locally).

Based on the information provided by the tenant a Reservation form will be prepared including all relevant information on the guests and the bank accounts to be used for the payments and the refund of the security deposit.

The booking will be made by the tenant through a pre-payment of 30% of the rental costs and the security deposit. The receipt of the pre-payment will be confirmed by way of a Booking form.

The remaining 70% will be due 7 weeks before arrival date. After receipt of this amount the tenant will receive a final booking confirmation together with detailed contact information and a route description.

In case of late payment of the amounts due, the tenant will automatically be in default and receive a notification by e-mail. If the amount due is not paid within 7 days, the agreement will automatically be dissolved.

The end cleaning costs are to be locally to the property manager prior to the check-out and can not be settled with the security deposit.

Cancellation costs
In case of a late cancellation (in the period of 7 weeks before arrival date), the tenant will be required to pay the full amount of the rental costs. Cancellation of a booking by the tenant is also regarded as a cancellation on behalf of the co-tenants. Any pre-payment of the security deposit will be refunded.

In case of an early cancellation (prior to the period of 7 weeks before arrival date), the tenant will required to pay 30% of the rental costs. Any pre-payment of the security deposit will be refunded.

In case of no show, the tenant will be required to pay the full amount of the rental costs. Any pre-payment of the security deposit will be refunded.

We advise our guests to enter into a travel insurance policy to cover any cancellation costs due to unforeseen circumstances.

Arrival and departure

The changeover day is Saturday and guest are expected to arrive between 16:00 and 19:00 hrs. The tenant is requested to contact the property manager approximately 2 hours before the expected arrival time. Arrivals after 19:00 hrs will only be possible in close consultation with the property manager and may lead to additional costs. We ask the tenant to pay any additional costs for a late arrival directly to the property manager.

Departures are expected before 10.00 hrs. The property manager will do the check-out together with the tenant. The check-out is intended to handle a number of practical matters, such as handing in the keys, depositing the linen and payment of the end cleaning costs. In addition, any defects and/or damages will need to be reported to the property manager. We also request the tenant to report any missing goods or keys.  The tenant will be held liable to compensate the owners for any damages or loss caused.

We advise our tenants to take notice of the departure checklist in the Information Guide of Borgo La Casa when preparing the departure.

The security deposit will be transferred to the bank account of the tenant within 3 days after departure date, taking into account the settlement of any damages to the holiday home as such or the content of the holiday home.

Number of guests
The maximum number of sleeps per holiday villa may not be exceeded, unless explicitly approved by the owners in writing. If, without permission of the owners, more guests will stay in the villa, the tenant will automatically be in default of his/her obligations under the rental agreement and he/she will be held liable to pay extra costs.

The extra costs will be charged at EUR 200 per person per night and will be settled with the security deposit paid in advance by the tenant. The tenant will be hold liable to compensate the owners for any deficit.

Defects
The tenant is obliged to inform the owners or the property manager of any defects in the property or the equipment within 24 hours after arriving in the holiday villa.

Liabilities

The tenant will be held liable for any damage to the holiday home (or the interior), caused during the stay of the tenant, unless otherwise evidenced. The damage, including any consequential damage, will be compensated by the tenant without judicial intervention being required. The owners will be entitled to compensate the damage with the security deposit paid in advance by the tenant. The tenant will be held liable for the amount of damage in excess of the security deposit paid in advance.

The owners do not accept any liability for any damage to the tenant as a result of deviations in the description of the holiday home, or the facilities at Borgo La Casa, or any inconveniences while staying at the property, unless these inconveniences are of such a nature that they will affect the essence of the rental agreement. In this case, the liability will be limited to any direct damages. Any form of consequential damage will be excluded. The liability of the owners will be limited to the amount of rental costs actually paid by the tenant.

The owners do not accept any liability for the damage, loss, theft, injury (or death) to persons or their personal belongings. By entering into a rental agreement the tenant agrees to indemnify and hold the owners harmless for any liabilities with respect to damage, loss, theft, injury (or death) to persons or their personal belongings which may arise out of or in connection with the tenant’s use and occupancy of the rental property in Borgo La Casa.

In case of force majeur as a result of war, strikes, nature, exceptional circumstances, the dead of (one of) the owners the owners or their relatives will be entitled to unwind the rental agreement without any compensation of extra costs. The tenant wil be entitled to a refund of the rental costs and the security deposit paid in advance.

Any errors in advertisements or other publications will not be binding for the owners.
